.The State of Michigan No Fault Law requires operators of automotive vehicles to purchase and maintain minimum basic coverage known as No Fault Insurance. The law is regulated by the Department of Insurance and Financial Services (DIFS). There are currently twelve (12) U.S. states and Puerto Rico under No Fault auto insurance laws: Florida, Michigan, New Jersey, New York, Pennsylvania, Hawaii, Kansas, Kentucky, Massachusetts, Minnesota, North Dakota, and Utah.
The No Fault Automobile Insurance Act MCL.500.3101 became effective in Michigan in 1973. The No-Fault Automobile Insurance Act in Michigan allows unlimited lifetime benefits for any persons involved in an accident with a private or commercial vehicle regardless of fault or injury for drivers, passengers, and pedestrians. That includes all reasonable charges incurred and necessary for products, services, personal care accommodations, living expenses, medical rehabilitation, transportation and mileage, work and wage loss, household replacement services, guardian and survivor loss benefits, and to cover funeral and burial expenses. Claims are generally filed against the injured party's auto policy, first. If there is no other personal protection insurance available through you, a household member, or the owner or driver of the vehicle, you may be entitled to recover accidental bodily injury benefits incurred during the accident through the Michigan Assigned Claims Plan (MCAP). The Michigan Assigned Claims Plan is a state agency who will assign your claim to a local auto insurance carrier. Operators of uninsured vehicles are excluded from these benefits. Passengers and pedestrians remain eligible even if the driver is uninsured. |

Claimants should be careful that their assigned case manager will work for their best interests rather than the insurance company.
When involved in an auto accident the injured party will likely experience loss of wages, multiple medical visits, disruption of normal activities, and other hardships that will require the need to make difficult decisions during the rehabilitative and legal processes. As case managers, we collaborate and work closely with your legal, and medical teams, work to immediately access and maximize your benefits, and concentrate on your recovery. That means that we work to prevent duplicate and unnecessary services or treatment, assess your personal safety and independence in the home, coordinate and obtain your medical care, secure medical supplies and equipment, obtain personal care and assistance in the home, arrange special transportation, and much more. Your medical care and progress are regularly reported to the insurance adjuster to ensure continuity of care. |
