Marshella Chidester Probable Cause Hearing (Bing Images, 2024) Eyewitnesses and victims testified to what they heard, saw and experienced of the incident while law enforcement experts delineated through the science of the investigation. The evidence was startling. Video footage captured everything from the very moment Mrs. Chidester left her home, engaged in another accident where she hit a tree and crashed her neighbors car before purportedly fleeing in the direction of the boat club where she drove her vehicle 25 feet through the building causing the death of two children and over a dozen other injuries. Tests revealed a blood alcohol level of 0.18, double the legal limits of the State of Michigan. The vehicle’s Event Data Recorder (EDR) showed a throttle percentage of 96.6% with the break off at a driving speed of 44.3 mph at the point of impact. In real world implications, the State’s case was able to show that not only was Mrs. Chidester ‘legally drunk’ but that she engaged in another accident, fled, and drove through the Swan Boat Club building at nearly 45 mph with the gas pedal to the floor, without breaking. Defense Attorney Bill Colovos tried to argue that the evidence failed to reach the standard of probable cause to charge his client with murder due to her medical conditions which caused her to black out and her legs to freeze.
