The abuse was discovered when police and the fire department responded to a Madison Heights mobile home approximately 2:30 p.m. after Elaina made an emergency call indicating Giovanni was not breathing. Authorities confirmed the child was unresponsive when they arrived and identified multiple injuries, according to reports.
The child was transported to the Ascension Macomb-Oakland Hospital and then transferred to Children’s Hospitals in Detroit where he succumbed to his injuries the next day. Autopsy reports determined the death was a homicide caused by blunt force trauma to the abdomen and a perforated bowel. His mother, Elaina Jennings, and her boyfriend, Daniel Giacchina have been charged with murder and first-degree child abuse after extensive evidence of severe abuse was uncovered. In a press conference on August 9, 2024, Oakland County Prosecutor, Karen McDonald described the abuse as one of the worst cases she had encountered. Daniel Giacchina faces additional charges regarding felony possession of a firearm and weapon possession by a prohibited person. Giacchina and Jennings are both additionally charged with lying to the police who accuse them of conspiring to blame Giovani’s injuries on the child’s biological father. After his arrest and, ultimate, release it was discovered that the child had been left in the care of his mother’s boyfriend, Daniel Giacchina. Evidence recovered during the investigation of Giovanni’s death included text messages, photographs, and videos documenting the abuses, which showed that he was often left injured and was allegedly mocked by his mother and her boyfriend, Giacchina.
What’s expected during the next hearing
During the preliminary exam prosecutors are expected to present substantial evidence collected, including witness statements and forensic data to the court. Magistrate Michael Mitchell will determine if the evidence establishes sufficient probable cause to move the case forward to trial. The case has garnered significant public attention, sparking calls for more robust child protection measures and scrutiny of systemic oversight lapses that may have allowed the abuse to continue undetected. Jennings and Giacchina remain held at Oakland County Jail without bond.
